Workky's CRM and automation features may include tools for content creation, ad campaign management, review monitoring, and social media. This page applies to those features.
No Guarantee of Results
Workky does not guarantee any specific outcome from marketing, advertising, content, or review activity, including but not limited to:
- Number of leads, appointments, or new clients
- Search engine ranking or visibility
- Ad click-through rates, conversion rates, or return on ad spend
- Number, content, or rating of online reviews
- Revenue, profit, or business growth
Marketing performance depends on many factors outside Workky's control, including market conditions, competition, the Customer's business, and platform algorithms.
Customer Approval Required
Customers are responsible for reviewing and approving content before it is published, sent, or used in any campaign. Workky's tools may suggest, prepare, or schedule content, but the Customer is the publisher.
Compliance Obligations
Customers must comply with:
- All applicable advertising laws, including FTC guidelines on endorsements, testimonials, and disclosure
- The terms of service and advertising policies of every platform where content is published (Google, Meta, TikTok, X, LinkedIn, and others)
- Privacy laws governing data used in marketing, including CCPA/CPRA, GDPR, and CAN-SPAM
- Federal and state AI transparency requirements, including disclosure obligations for AI-generated content where required
- Industry-specific advertising regulations
Law Firm Marketing
For law firm Customers, marketing content must comply with all applicable attorney advertising rules in every jurisdiction where the firm practices, including but not limited to ABA Model Rules 7.1 through 7.3 and the corresponding state-bar rules. This includes restrictions on testimonials, comparative claims, solicitation, specialization claims, and required disclosures (such as "Attorney Advertising" labels). Law firms are solely responsible for ensuring their marketing meets these requirements before publication.
Reviews
Where Workky helps Customers request, monitor, or respond to online reviews, Customers must:
- Comply with FTC guidelines and platform policies on review solicitation
- Not offer compensation, discounts, or other incentives in exchange for positive reviews unless properly disclosed
- Not write or publish fake or misleading reviews
- Respect the privacy of clients and patients in any public response
