AI Disclosure & Call Recording Notice

Workky builds Emma to be transparent with every person she speaks to. This page explains what callers are told, why, and what that means for the businesses that use Emma.
How every conversation starts
Every phone call begins with a spoken disclosure like this:
"Hi, this is Emma, the virtual assistant for [Business Name]. I'm an AI, not a person, and this call is recorded so the team can follow up. How can I help you today?"
On a website, the visitor sees the same notice before the conversation starts: they tick one box confirming that Emma is an AI receptionist and that the conversation is recorded. The conversation cannot start without that tick. Emma then begins with the business's greeting.
The disclosure cannot be turned off by the business. If a caller asks whether they are speaking to a person, Emma always answers honestly that she is an AI. A caller can ask for a human at any time; Emma will take a message or transfer according to the business's settings.
Why we do this
- California's bot disclosure law (Business & Professions Code §17940 et seq.) prohibits using a bot online — for example, Emma's website chat — to mislead a person in California about the fact that it is a bot. Emma discloses up front on every channel, phone included, even where the law does not strictly require it.
- California is an all-party consent state for call recording (Penal Code §§632, 632.7). Every participant is told about recording before it starts: Emma says it at the start of a phone call, and a website visitor ticks the notice before the conversation begins. Continuing the call after the announcement, or starting the conversation after the tick, is consent. Many other states have the same rule; Emma's announcement is designed to satisfy all of them.
- Professional-conduct rules for lawyers, healthcare providers, and other licensed professionals require honesty with the public. Emma never claims to be a lawyer, pharmacist, doctor, or staff member, and never gives professional advice.
What Emma will not do
- Give legal, medical, pharmaceutical, financial, or other professional advice.
- Claim to be human.
- Contact emergency services. If a caller describes an emergency, Emma tells them to hang up and call 911.
- Place outbound sales or marketing calls.
What happens to the recording
Recordings and transcripts are stored securely, delivered to the business that owns the phone line, and kept for 90 days by default (the business can change this). They are never used to train AI models. See our Privacy Policy.

You are responsible for confirming that recording and AI disclosure are lawful for your business and your callers' locations, and for any additional notices your profession requires (for example, on your website or intake forms).
