Legal Ethics and AI Intake: How Firms Should Oversee Emma

AI intake raises real ethics questions. Workky's default Emma script begins with AI disclosure; firms control the final configuration and remain responsible for notices, consent, professional conduct, and oversight.

    April 3, 2026

When law firms evaluate AI agents, they should consider disclosure, confidentiality, accuracy, supervision, and the unauthorized practice of law. No software can guarantee a firm's compliance; the firm remains responsible for its professional obligations.

    Clear AI Disclosure

Workky's default Emma script begins with AI disclosure; customers control the final script/configuration and remain responsible for required notices and consent. Emma does not claim to be an attorney or member of the legal team. Firms should review the configured greeting and intake flow for their jurisdiction and practice.

Workky's default Emma script begins with AI disclosure before intake questions. Firms can edit the greeting and remain responsible for required notices and consent. The default opening is:

"My name is Emma — I'm an AI virtual intake assistant, not an attorney or a member of the legal team. I can help collect information for the firm."

The default script answers questions about whether Emma is AI truthfully and does not present Emma as a person. Firms should verify their configured script before use.

    Confidentiality and Relationship Formation

Firms should configure intake, access, retention, and notices for their confidentiality duties and review Workky's Security and Privacy materials. Firm-directed confidential intake does not itself create an attorney-client relationship.

Firm Supervision Under Formal Opinion 512

Emma does not provide legal advice. The firm remains responsible for professional conduct, including competence, confidentiality, supervision, accuracy, and fees as discussed in ABA Formal Opinion 512.

    • Full call transcripts available to the supervising attorney
    • Automated quality scoring flags any response issues
    • Clear escalation path — Emma transfers to a human when needed
    • The attorney remains responsible for all legal guidance

    No Unauthorized Practice of Law

Emma does not interpret laws, assess case outcomes, estimate settlement values, or advise callers on legal strategy. If a caller asks for legal guidance, Emma responds: "That's a great question for the attorney — I want to make sure you get accurate legal guidance. I'll note that for your consultation."

    Designed With Attorneys

Every firm should review its Emma configuration against applicable rules in each jurisdiction where it practices and consult its own legal or ethics counsel when appropriate.
